Wills & Dealing with Assets when Someone Dies

Making a will is something lots of people put off - but why leave it to chance. Making a will is not expensive and can save a lot of money. We can advise on reducing Inheritance Tax and assist with the administration of the estate (known as Probate) when someone dies.

We appreciate that dealing with a deceased’s estate and effects is not an easy task, so let us take the burden away from you. We often visit clients in hospitals, residential homes, their own homes, or elsewhere as appropriate. Lasting Power of Attorney

From the beginning of October 2007 it is no longer possible to make an Enduring Power of Attorney (EPA) although all EPAs made before the end of September 2007 remain valid.

The successor to an EPA is a property and affairs lasting power of attorney (LPA) and it is now also possible (by way of a separate document) to make a personal welfare LPA.

A property and affairs LPA can be used to appoint one or more attorneys to make decisions on your behalf regarding your property and financial affairs.

A personal welfare LPA might authorise the attorneys to make decisions about the Donor’s health and personal welfare, such as where the donor should live, consenting to or refusing medical treatment on the donor’s behalf and also aspects of your day-to-day care.

For those who wish to ensure that decisions about their welfare and property and affairs are made by those they trust the making of a personal welfare LPA and/or a property and affairs LPA is a very sensible step to take and Fulchers will be pleased to provide advice and further information.

Divorce & Separation

Pre-Nuptial Agreements

If you are planning to marry, you may wish to discuss and set out how you will hold your individual assets and try to define what will happen in case unfortunately the marriage breaks down.

Whilst Pre-Nuptial agreements are not currently enforceable in England and Wales, they may be an important factor when looking at the financial arrangements on a divorce. The level of importance will vary and will depend on the facts surrounding your case. However it may be taken into account as one of the circumstances when considering the division of assets.

A Pre-Nuptial Agreement may be useful if there are substantial assets or a business involved and you wish to try and protect your financial position for the future.

Every case is individual and it is essential that both parties take independent legal advice. It is therefore important that you obtain advice on your particular circumstances.

Cohabitation Agreements

A high percentage of cohabitating couples do not have written agreements about ownership of the family home. Every cohabitating couple should carefully consider entering into a Cohabitation Agreement, especially if they have children.

A Cohabitation Agreement can specifically record how the parties intend to share the proceeds of sale in the event of a relationship breakdown. Such an agreement can also deal with personal property and household items as well as intentions with regard to the couple’s financial arrangements.

Time and effort organising these affairs from the outset can save costs in the event that the relationship should break down. Prior to purchasing a home with your partner, consider entering into a Cohabitation Agreement.

Collaborative Law

To ease the pain of divorce or separation it is possible for both of the former couple to consult a collaborative lawyer with the aim of the two collaborative lawyers and the couple working together for the benefit of the family to avoid lengthy and stressful court proceedings.

Whilst it may not suit everyone, if a couple can each select their own Collaborative Lawyer from different firms, before they begin the divorce process, it can improve the chances of everyone in the relationship remaining on friendly terms. This can be particularly important when there are children involved.

Domestic Violence & Emergency Injunctions

Domestic violence includes many different types of behaviour not only physical violence, such as hitting and pushing around, but also non physical violence in the form of bullying, intimidating and threatening a partner.

We aim to offer sympathetic but effective and practical advice on how to protect yourself at times of crises and threat. We will look at all alternatives to Court proceedings and put you in touch with any organisations or other groups who can offer help and support.

Children Cases

When couples separate, whether married or not, it is sometimes difficult to agree arrangements for the children, such as where they should live, who with and how often the other parent sees the children.

Fulchers take pride in the quality of service and legal advice we give to our clients. We believe that building trust with our clients is of utmost importance in often difficult and distressing times.

We can help you to make the arrangements by writing to your ex-partner and hopefully reaching an agreement. Sometimes, unfortunately, parents cannot agree and an application will need to be made to Court.

We deal with Court applications for Residence, Contact, Care Orders, Emergency Protection Orders, Adoption, and International Abduction matters tracing the whereabouts of missing children.

We appear in all courts including regular appearances in the High Court.

Care Proceedings and Child Protection

Social Services have a duty to protect vulnerable children and if any report is made to them that a child has suffered harm or is likely to suffer harm they are duty bound to investigate and, if they consider appropriate, will start what are termed Care Proceedings.

This can be a very frightening process for parents who may well be deeply upset by any injury their child may have suffered or who may dispute the allegations made about the safety or welfare of their child. We can help in many ways.

For the children involved we may be appointed by the Court to represent the interests of children in Care Proceedings. For parents - We represent parents or other relatives who are involved in Care Proceedings.
